The High Court today has directed the Election Commission (EC) to fix a new date for the by-polls in the Sylhet-3 constituency by September 7 due to constitutional constraints.
The Virtual High Court bench headed by Justice M. Enayetur Rahim passed the order on hearing of the writ petition on Thursday.
Lawyer Mohammad Shishir Monir was present for the writ and Attorney General AM Amin Uddin and Deputy Attorney General Bipul Bagmar were hard for the state.
Earlier, the High Court had adjourned the by-elections to the Sylhet-3 constituency of the Jatiya Sangsad, which was scheduled to hold on July 28, till August 5 due to fears of increased coronavirus cases.
Lawyer Mohammad Shishir Monir had filed the writ petition in the High Court on behalf of seven locals and six lawyers seeking postponement of the Sylhet-3 by-election.
A legal notice was sent to Chief Election Commissioner (CEC) KM Nurul Huda on July 25 requesting him to postpone the by-polls in the Sylhet-3 constituency. However, the writ was filed as he didn’t respond to the notice.
It is to be mentioned that Sylhet-3 MP Mahmud Us Samad Chowdhury died of Covid-19 on March 11 this year. Then on March 15, the EC declared the seat vacant. 90 days after the announcement of the schedule, the polling day was set for July 28.
