Rifat murder: Appeal of 3 accused accepted, fine adjourned

The High Court has accepted the appeals of three convicts sentenced to death in the Rifat Sharif murder case in Barguna. At the same time, the fine of the accused has been adjourned till the appeal is disposed of.
Meanwhile, Rifat’s wife Minni’s appeal hearing will be presented before the court by her lawyers next Sunday.
Although the two accused, out of the six convicted accused, appealed, no information about whether an order has been issued against them did not get.
The High Court bench of Justice M. Enayetur Rahim and Justice Md. Mostafizur Rahman passed the order on October 13 on separate petitions of the three accused.
The three accused are — Al Qayyum alias Rabbi Akon, Md. Hasan and Md. Rezwan Ali Khan Hridoy aka TikTok Hridoy.
The appeal of these three persons has been admitted (accepted for hearing). Besides, the court has suspended the fine till the appeal is disposed of.
Minni’s lawyer Makkia Fatema Islam said they would present the appeal before the court on Sunday.
The other two accused, Mohaiminul Islam Sifat and Rakibul Hasan Rifat Faraji, were reported to have appealed, however, it was not known whether any order had been issued.
Last September 30, Barguna District and Sessions Judge Md. Ashaduzzaman announced the verdict in the murder case of Rifat Sharif.
The court gave the death penalty to 6 of the 10 adult accused. Besides, the accused was also fined Tk 50,000. The remaining 4 were acquitted.
Later, as per the rules, the death reference of the six accused reached the High Court for approval on October 4. Besides, other accused including Minni appealed on October 6.
Lawyers said the High Court’s approval was required for the execution when the court sentenced the death penalty to the accused in a criminal case. Therefore, the concerned judicial court sent all the documents of the case to the High Court in accordance with Section 374 of the Criminal Procedure Code — which is known as ‘Death Reference’.
After receiving the documents, the Death Reference Branch of the High Court examined and prepared the paper book of the case. Once the paperbook is ready, the case is presumed to be ready for hearing, the lawyers added.
However, in some cases, the paperbook is prepared based on the priority under the direction of the Chief Justice.
The convicted accused are — Md. Rakibul Hasan Rifat alias Rifat Faraji, Al Qayyum alias Rabbi Akon, Mohaiminul Islam Sifat, Rezwan Ali Khan Hridoy alias TikTok Hridoy, Md. Hasan and Ayesha Siddique Minni.
The acquitted are — Md. Musa (fugitive), Rafiul Islam Rabbi, Md. Sagar and Kamrul Islam Simon.
Nayan Bond and his accomplices publicly hacked Rifat Sharif with machetes in broad daylight on June 26, 2019, in front of Barguna Government College and seriously injured him. The injured Rifat later died at Barishal Sher-e-Bangla Medical College Hospital.
On September 1, police filed a chargesheet against 24 people, including Rifat’s wife Minni, in the Rifat Sharif murder case with the Barguna Senior Judicial Magistrate’s Court. At the same time, the prime accused in the Rifat murder case, Nayan Bond, was killed in a gunfight, so he was acquitted.
On January 1, the Barguna District and Sessions Judge’s Court framed charges against 10 adults accused in the Rifat murder case. After the testimony and arguments, the verdict was announced on September 30.
On the other hand, on January 8, the Barguna Children’s Court framed charges against 14 juveniles accused in the Rifat murder case.
According to court sources, after the testimony of 74 witnesses against the 14 juvenile accused in the Rifat murder case, the court set October 27 for giving the verdict.
Barguna Children’s Court Judge Md. Hafizur Rahman, on October 27, has sentenced six juvenile accused to 10 years, four accused to 5 years, and one accused to 3 years imprisonment in the murder case of Rifat Sharif in Barguna. Besides, three accused have been acquitted.
