Medical report not mandatory in rape case: HC

Medical reports are not mandatory to proving rape cases and punishment can be given considering the surrounding situation and evidence.

A High Court bench headed by Justice Rezaul Haque passed the verdict on Wednesday. At the same time, if a victim files a case late, it cannot be called a lie.

The definition of rape case states that the accused cannot be convicted in any way without a medical report. Medical reports are therefore one of the weapons to prove rape cases. But the High Court on Wednesday ruled that from now on, rape cases punishment can be awarded without considering the medical reports.

Even if the allegations brought against the accused are proved by the oral and circumstantial testimony of the victim, the accused can be sentenced on the basis of it.

Moving away from the previous maximum punishment an ordinance was issued on Tuesday providing the death penalty as the maximum punishment for rape.
