Hearing on writ seeking stay city polls today

The High Court’s hearing on a writ petition filed seeking deferment of Dhaka City Corporation election due to the voter list update and many other reasons will be held today.
The hearing will be held on a bench comprising High Court Justice JBM Hasan and Justice Md. Khairul Alam. Earlier, the same bench last Thursday fixed the date.
On January 22, lawyer Yunus Ali Akand filed the writ while Secretary of the Law Ministry and Local Government Ministry, the Chief Election Commissioner and the Returning Officer of the two cities of Dhaka were made the defendant.
Grounds of the writ say that in the City Corporation Election Rules of 2010, there are provisions for the signature of three hundred voters in the case of an independent mayoral candidate. But it is discriminatory for not having such provisions for the party candidate and it is confrontational with Articles 7, 19, 26, 27, 28 and 31 of the Constitution.
On the other hand, 30th January was announced for the city polls at first. And later, the schedule was subsequently amended to make February 1 an election day. But according to the rules, there is no scope to amend the election schedule rather than announcing a new schedule.
According to Rule 27 of the 2010 City Corporation Election Rules, the voter list of the City was not updated before the election. According to Rule 11(1), there are rules for updating the voter list from 2nd to 31st January every year. But the draft voter list was released on January 20. However, even if the voter list is still up to date on January 31, new voters will be excluded from the list.
